All services are offered on a project-based or retainer basis and are customized according to client requirements. We reserve the right to update, modify, or discontinue any service without prior notice in compliance with California and U.S. laws.

3. Client Responsibilities

Clients agree to provide accurate information, timely approvals, required assets, and clear communication necessary to execute marketing campaigns effectively. Delays caused by incomplete information, late feedback, or third-party dependencies may impact timelines. Clients are responsible for ensuring that all provided content, claims, and materials comply with advertising laws and platform policies.

4. Payments and Billing

All fees, payment schedules, and deliverables are outlined in the agreed proposal or service agreement. Work begins only after receipt of the required deposit or payment. Late or missed payments may result in suspension of services. Unless stated otherwise in writing, all payments are non-refundable. Pricing does not guarantee specific performance outcomes, as marketing results may vary.

5. Influencer Content & Licensing Rights

Content created by influencers may only be used within the scope of agreed licensing terms. ProFirst Mortgage facilitates content usage permissions but does not assume ownership unless explicitly stated. Unauthorized use, redistribution, or resale of influencer content beyond agreed terms is strictly prohibited and may result in legal action under California intellectual property laws.

6. Platform Compliance & Third-Party Services

Our services may involve third-party platforms such as TikTok, Instagram, Meta Ads, analytics tools, or influencer marketplaces. ProFirst Mortgage is not responsible for platform outages, policy changes, account restrictions, or algorithm updates imposed by third-party providers. Clients must comply with all applicable platform terms and advertising regulations.

7. Performance Disclaimer

While we implement proven strategies and best practices, ProFirst Mortgage does not guarantee specific results such as sales, leads, engagement levels, or revenue growth. Marketing performance depends on multiple external factors including audience behavior, platform algorithms, budget, and creative execution.

8. Limitation of Liability

To the fullest extent permitted by California law, ProFirst Mortgage shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, business interruption, or data loss. Our total liability, if any, shall not exceed the amount paid by the client for the specific service giving rise to the claim.

9. Confidentiality & Data Protection

All client information, campaign data, and business details shared with ProFirst Mortgage are treated as confidential. We use reasonable security measures to protect sensitive information and do not disclose client data to third parties except as required for service delivery or by law.

10. Termination of Services

Either party may terminate services by providing written notice. Clients remain responsible for payment of all completed work and active commitments up to the termination date. ProFirst Mortgage reserves the right to terminate services immediately in cases of non-payment, breach of terms, misuse of services, or unlawful activity.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the State of California and applicable federal laws of the United States. Any disputes shall be resolved exclusively in the courts located within California. By using our services, you consent to this jurisdiction.
